EventMail Terms of Use

Welcome to EventMail! By using our service, you agree to comply with and be bound by the following Terms of Use. Please read these terms carefully. If you do not agree to these terms, you may not use our service.
1. Acceptance of Terms
By registering for and/or using the EventMail platform, you agree to these Terms of Use, our Privacy Policy, and any other policies or guidelines we may provide. These terms constitute a binding agreement between you ("User") and EventMail.
2. Account Registration and Usage
- To access EventMail, you must create an account. Guest usage is not permitted.
- There are no specific restrictions on who can create an account; however, you must provide accurate, complete, and current information during registration.
- You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.
3. Payment and Subscription
EventMail offers two subscription tiers:
- Free Tier: For demo/testing purposes, no payment is required. Includes up to 15 subscribers, 1 mailing list, basic templates, basic support, no subscriber analytics, and a custom email domain (for testing).
- Business Tier: For 12€/month, includes up to 1,000 subscribers, unlimited mailing lists, custom templates, priority support, subscriber analytics, and a custom email domain.
Refund Policy:
- Business tier users may cancel and request a refund within the first 48 hours of usage. After this period, cancellations will not result in refunds.
4. User Responsibilities
- Users are solely responsible for the content of the emails they send through EventMail.
- Sending spam, phishing, or other prohibited content is strictly forbidden.
- EventMail reserves the right to:
- Inspect email content for compliance with anti-spam/phishing policies.
- Suspend or delete accounts in cases of abuse or violations of these terms.
- Suspend accounts indefinitely if subscriber complaints are raised against the user.
5. Service Limitations and Liabilities
- EventMail guarantees the delivery of emails, up to a limit of 5,000 emails per day per account.
- Service interruptions or errors may occur despite rigorous testing. Users will be notified of significant disruptions.
- EventMail is not liable for any damages resulting from service interruptions or email delivery failures.
6. Intellectual Property
- EventMail’s preconfigured email templates are free to use without EventMail branding.
- Users may customize emails entirely to their own branding and design without attributing EventMail.
7. Privacy and Data Protection
- EventMail collects and analyzes subscriber click data for analytics (Business Tier only).
- User email content may be monitored to prevent abuse, such as spam or phishing.
- Subscriber email addresses are securely stored and encrypted in transit.
- EventMail complies with the EU General Data Protection Regulation (GDPR).
8. Termination of Accounts
- EventMail reserves the right to terminate or suspend accounts in cases of abuse, such as:
- Sending spam or phishing emails.
- Sending more than 5,000 emails per day.
- Receiving multiple complaints from subscribers.
- Termination is at EventMail’s sole discretion and may occur without prior notice.
9. Governing Law
- These Terms of Use are governed by and construed in accordance with the laws of Germany.
- Users agree to submit to the exclusive jurisdiction of the courts of Germany for any disputes arising out of these terms.
10. Changes to the Terms
- EventMail reserves the right to modify these Terms of Use at any time.
- Users will be notified of changes via email or through the platform. Continued use of EventMail constitutes acceptance of the updated terms.
